Easybell App Privacy Policy
Privacy Policy of Easybell CH AG (hereinafter ‘Easybell’)
This Privacy Policy applies to customers of Easybell CH AG in Switzerland.
1. General information
This privacy notice applies to the use of the Easybell app provided by Easybell CH AG.
It constitutes a product-specific privacy notice within the meaning of section 19 of our general privacy notice. That general privacy notice applies in addition and governs, in particular, the processing of personal data when visiting our websites, when contacting us and within the scope of contractual relationships, as well as the principles of data processing, data security and your rights. Unless this notice provides otherwise, the general privacy notice applies.
Personal data is processed in accordance with Swiss data protection law, in particular:
- the Federal Act on Data Protection (FADP, revised version),
- the Data Protection Ordinance (DPO),
- the Telecommunications Act (TCA) and the implementing and enforcement provisions applicable in each case.
European legislation (e.g. the GDPR) applies as well where it is applicable.
The processing of certain personal data is strictly necessary for the app to function. Without this data, the Easybell app cannot be operated.
2. Controller
The controller responsible for the processing of personal data is:
Easybell CH AG
Multergasse 11
9000 St. Gallen
Switzerland
E-mail: datenschutz@easybell.ch
Web: www.easybell.ch
3. Technical provision and processing on our behalf
3.1 App and voice infrastructure
The Easybell app and the server components required to operate it are provided technically by
easybell GmbH
Brückenstrasse 5a
10179 Berlin
Germany
To provide the telecommunications services, technical components of a central voice infrastructure located in Germany are used, which is operated by easybell GmbH.
In this context, easybell GmbH processes personal data exclusively as a processor within the meaning of Art. 9 FADP and exclusively on the instructions of Easybell CH AG, without any authority of its own to decide on the purposes or means of the processing. Full responsibility for the data processing lies with Easybell CH AG.
3.2 Push notifications
For push notifications to work, your account must be registered remotely when the Easybell app is running in the background or is closed on your iOS or Android device. For this purpose, your SIP account data is transmitted to SIPIS via a secure HTTPS connection. SIPIS is the server that processes push notifications; it is operated by easybell GmbH as a processor pursuant to Art. 9 FADP.
This information is not passed on to any other third parties. It is deleted as soon as the push instance expires – as a rule within three to six days, depending on the configuration of the SIP account – or as soon as you deactivate push notifications in the app.
If the SIP account is configured to use one of our multitasking methods instead of push notifications, this information is not transmitted to SIPIS.
3.3 Crash reports and diagnostics
To ensure the stability and performance of the app, we use Firebase Crashlytics, a crash reporting service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. The service helps us identify and resolve technical problems by collecting pseudonymised crash reports when an error occurs in the app.
By default, Firebase Crashlytics does not collect any data that allows you to be identified directly. The data collected includes in particular:
- device model and operating system version
- version and build number of the app
- stack traces and logs relating to crashes
- time and frequency of crashes
- installation ID of the app (Firebase Installation UUID)
- further technical information used to diagnose problems
Your IP address may be processed temporarily for routing purposes, but is not stored or logged by Crashlytics.
This data is used exclusively for troubleshooting and for improving the stability of the app. It helps us to diagnose and resolve crashes, to improve the reliability and performance of the app, and to understand how crashes affect different devices and operating system versions. Crash reports are not evaluated to track user behaviour or to create profiles.
Crash reports are processed on Google servers; in this context, data may be transferred to Google LLC in the USA. For this disclosure abroad we rely on the standard contractual clauses approved by the European Commission, which are recognised for Switzerland by the Federal Data Protection and Information Commissioner (FDPIC). Crash reports are deleted after 90 days.
Further information on the processing of crash data by Google can be found in Google's privacy policy and in the Firebase privacy and security policies.
4. Purposes of processing
Personal data is processed in connection with the Easybell app for the purposes of:
- providing and operating the app and its functions,
- establishing and maintaining telecommunications connections,
- billing for use of the service,
- ensuring network, operational and IT security,
- analysing errors and faults,
- complying with legal obligations.
5. Categories of personal data
Depending on how the app is used, we process in particular the following categories of personal data:
5.1 Account and configuration data
- SIP account data
- settings and entries made in the app
5.2 Telecommunications and traffic data
- telephone numbers
- time, duration and type of connections
- technical routing and signalling data
The content of communications is not processed unless this has been expressly agreed or is required by law.
5.3 Technical access data
When using functions that require server components such as push notifications or other web services, the IP address and browser or device information may be logged by the servers. These logs are rotated automatically; the information they contain is evaluated only to remedy specific faults or where required by law.
On macOS and iOS we use the operating system's DNS resolver. On other platforms we use the DNS servers provided by the operating system. Should this not be possible, a connection to root name servers may be established as a fallback.
5.4 Usage data
For billing purposes, the servers record whether the app has been actively used during the current month. This is recorded by means of a pseudonymised identifier reported by the app when it is used.
5.5 Diagnostic data
See section 3.3.
6. Origin of the data
The personal data originates:
- from your entries in the app,
- from your use of the app and the associated services,
- from the customer data held by Easybell CH AG.
7. Storage location
Personal data is processed on servers in Germany. Beyond this, disclosure abroad takes place only in the cases set out in this privacy notice, namely in connection with the crash reports described in section 3.3.
8. Retention period
The personal data processed is necessary for the operation of the app. It is processed for as long as the app is used.
If you decide to stop using the app and to uninstall it, the personal data collected in connection with the app can be deleted on request. This does not apply to:
- data collected on the basis of the customer relationship with Easybell CH AG – our general privacy notice applies to such data,
- data that we are required to retain in order to comply with statutory or contractual retention obligations.
Where the purpose of storage no longer applies or a prescribed retention period expires, your data is blocked or deleted as a matter of routine and in accordance with statutory provisions.
9. Data security
We take technical and organisational security measures to protect your personal data against manipulation, loss, destruction and access by unauthorised persons. Account data is transmitted to the server components in encrypted form only.
In all other respects, the provisions of section 15 of our general privacy notice apply.
10. Your rights
Your rights in relation to your personal data – in particular the right to information and rectification, the right to restriction of processing, the right to erasure, the right to data portability, the right to object and the right to lodge a complaint – are described in section 17 of our general privacy notice. You can exercise these rights at any time by writing to datenschutz@easybell.ch.
The following applies in addition to the Easybell app:
Rectification. If the personal data processed in connection with the app is incorrect or incomplete, please contact us using the contact details given above. We will rectify the data without delay.
Erasure. To have the personal data collected in connection with the app deleted, please uninstall the app and inform us of your request using the contact details given above. Please note that use of the Easybell app depends on the processing of this personal data and that the app cannot be operated without it. Section 8 applies to data arising from the customer relationship.
Complaints. Complaints in Switzerland may be addressed at any time to the Federal Data Protection and Information Commissioner (FDPIC): FDPIC, Feldeggweg 1, CH-3003 Bern, http://www.edoeb.admin.ch. If you are located in the EU or the GDPR applies, you may also contact the competent data protection supervisory authority in your country of residence.
11. Amendments to this privacy notice
This privacy notice may be amended where legal, technical or organisational changes make this necessary. The version currently published on our website applies in each case.
