The protection of your personal data is a top priority for Easybell CH AG. This Privacy Notice explains how we process your personal data when you:

• use our telecommunications and other services,
• have a contractual, supplier, or partner relationship with us.

This Privacy Policy applies equally to website visitors, prospective customers, customers, partners, and suppliers.

The processing of personal data is carried out in accordance with Swiss data protection law, in particular the

In this context, Easybell GmbH processes personal data exclusively as a data processor within the meaning of Art. 9 of the DSG and solely in accordance with the instructions of Easybell CH AG.
The processing takes place on servers in Germany.

To provide telecommunications services, technical components of a central voice infrastructure in Germany are used, which is operated by Easybell GmbH.

In particular, operational and traffic-related personal data is processed to the extent necessary for:

• establishing and maintaining telecommunications connections,
• billing,
• ensuring network and operational security,
• error and fault analysis

Easybell GmbH processes this data exclusively as a data processor in accordance with Art. 9 of the DSG, without having any decision-making authority regarding the purpose or means of data processing.

Responsibility for the content of the data processing lies entirely with Easybell CH AG.

The processing of personal data is carried out in accordance with the principles of:

• Lawfulness, transparency, and purpose limitation
• Proportionality and data minimization
• Accuracy and timeliness
• Integrity, confidentiality, and data security
• Limitation of retention

Children (up to the age of 18) should not submit any personal data to us without the consent of their parents or guardians. We urge all parents and guardians to teach their children how to handle personal data safely and responsibly online. We will not knowingly collect, use in any way, or disclose to third parties any personal data from children.

Depending on the nature of the use, we process the following categories of personal data in particular:

The personal data comes from:

• from your use of our services,
• from legally permissible third-party sources (e.g., network or interconnection partners).
   

Personal data is processed, in particular, for the purpose of:

• Providing and operating our websites
• Initiating, establishing, and fulfilling contractual relationships
• Providing telecommunications services
• Billing and accounts receivable management
• Customer service and support
• Ensuring network, operational, and IT security
• Compliance with legal obligations

We collect your personal data in two ways: (1) indirectly (e.g., through our website’s technology) and (2) directly (e.g., when you send us an email or when we enter into a contract with you).

9.1.1 Server Log Files

We collect data on our website when a page is accessed and store it as “server log files.” The following information is recorded:

• Name of the accessed webpage
• Date and time of the request
• Amount of data transferred
• Confirmation of successful access
• Browser type and version
• The user’s operating system
• Referrer URL (the previously visited page)
• IP address and the requesting provider

Storing this information in so-called server log files is necessary for technical reasons, to ensure system security, and for troubleshooting. This data is analyzed exclusively for statistical purposes and to improve the quality of our website. 

We delete these server log files immediately after the user session ends.

The legal basis for this data processing is our legitimate interest.

9.1.2 Cookies

When you visit our website, we may store information in the form of a cookie on the computer or mobile device you are using. 

Actively accepting such cookies is not a prerequisite for visiting our website or using our online services. Please note, however, that certain features are only available if you allow us to set cookies. For further information, please refer to our cookie banner.

What are cookies?
Cookies are small files that are stored on your storage device and save certain settings and data for exchange with our system via your browser. Generally, there are two different types of cookies: so-called session cookies, which are deleted when you close your browser, and temporary or persistent cookies, which are stored on your device for an extended period or indefinitely. This allows us to tailor our website and online services to your preferences and make them easier for you to use.

Which cookies do we use?
Most of the cookies we use are automatically deleted from your device at the end of the session (hereinafter also referred to as “session cookies”). In addition, we also use cookies that remain on your device even after the session has ended. When you continue to use the website, the system automatically recognizes that you have already visited us. These temporary or permanent cookies (lifespan: 1 month to 2 years) are stored on your device. The reference data stored on our web server for these cookies is automatically deleted after the specified period has expired. The primary purpose of these cookies is to make our website more user-friendly, effective, and secure.

How can I prevent cookies from being stored?
Rejecting cookies will affect the functionality of our website. As a result, you may not be able to use all the features and services we offer.

9.1.3 Matomo

We use Matomo analytics software to statistically analyze user behavior on our website. To do this, Matomo processes your truncated IP address, page views, timestamps, device, and browser information. This software is hosted by Easybell GmbH in Germany.

9.1.4 Analytics (Google & HubSpot)

Our website uses Google Analytics and HubSpot for analytics. Google Analytics is a web analytics service provided by Google Ireland Limited (Gordon House, Barrow Street, Dublin 4, Ireland, www.google.com/intl/de/privacypolicy.html. HubSpot Inc. (25 First Street, Cambridge, MA 02141, USA, legal.hubspot.com/de/privacy-policy) is a provider of CRM and marketing software.

On our behalf, both Google and HubSpot collect data from you in the form of cookies when you visit our website in order to analyze your use of our website. 

9.1.5 Google Signals

We have enabled the Google Signals feature in Google Analytics. If you have authorized personalized ads in your Google Account, this feature updates the functionality of Google Analytics to collect aggregated and anonymized data from you. Data is collected via cross-device tracking. This allows your data to be analyzed across devices. When Google Signals is enabled, data is collected and linked to your Google account. 

Google Signals also collects additional user data in Google Analytics. In addition to your interests, this includes demographic characteristics such as your age, location, city of residence, language, and gender. Social characteristics such as your occupation, marital status, or income may also be collected. By collecting these characteristics, Google Analytics can define user groups or target audiences.

The purpose of data collection and processing via Google Analytics and Google Signals is to better understand your behavior, preferences, and interests. This allows services and products to be tailored and optimized for you. 

The data collected in this manner is retained for 26 months. In your Google Account, you can manage this data, customize its use, and delete it.

9.1.6 Google Tag Manager

We implement Google Analytics (Universal) using the so-called “Google Tag Manager.” Google Tag Manager is also a Google product that allows us to manage website tags through a single interface. Google Tag Manager is a cookie-free domain and does not collect any personal data. The tool triggers other tags, which may in turn collect data. Google Tag Manager does not access this data. If deactivation has been performed at the domain or cookie level, it remains in effect for all tracking tags implemented using Google Tag Manager.

9.1.7 Google Ads and Remarketing

Easybell uses Google Ads and Google Remarketing. These are advertising services provided by Google Inc. (“Google,” Mountain View, USA). These features are used to present interest-based ads to website visitors within the Google advertising network. To do this, the browser stores cookies that make it possible to recognize the user or the browser when they visit websites that are part of Google’s advertising network.

Alternatively, you can prevent remarketing by disabling cookies in your browser settings.

9.1.8 Microsoft Clarity

We work with Microsoft Clarity and Microsoft Advertising to track how you use and interact with our website using behavioral metrics, heatmaps, and session replays to improve and market our products and services. Website usage data is collected using first-party and third-party cookies and other tracking technologies to determine the popularity of products/services and online activities. We also use this information to optimize the website, for fraud and security purposes, and for advertising.

9.1.9 HubSpot

We use HubSpot, a service provided by HubSpot Inc. (USA) and HubSpot Germany GmbH, Am Postbahnhof 17, 10243 Berlin, to analyze website visits, automate marketing, and manage customer relationships (CRM).

Purpose of processing:
Processing is carried out to analyze user behavior on our website, to optimize our marketing measures, and to improve customer communication. In doing so, personal data such as IP addresses, pages visited, timestamps, form content, and interactions with our website may be collected and stored.

In addition, in connection with requests for quotes and orders, we store other personal data such as company name, contact person, email address, phone number, and mailing address. As part of communication with our sales team, the content of conversations may also be documented in writing to ensure consistent and targeted customer service.

Cookies and Tracking:

9.2.1 Email / Contact Form

If you send us an email, fill out the contact form, or request a quote, the personal data you voluntarily provide will be used solely for correspondence with you. 

These communications are stored in the inboxes of the respective email addresses. The email service provider is Microsoft with Office 365 (Microsoft Ireland Operations Ltd., One Microsoft Place, South County Business Park, Leopardstown, Dublin 18, Ireland). Your data is stored in Switzerland/the EU.

9.2.2 Newsletter

On our website, you have the option to subscribe to our newsletter. The technical distribution of the newsletter is handled by HubSpot Germany GmbH, Am Postbahnhof 17, 10243 Berlin 

You can unsubscribe from the newsletter at any time. Once you have unsubscribed, your data will be immediately deleted from the mailing list.

9.2.3 Advertising Purposes for Existing Customers

We use your personal data based on our legitimate interest to maintain customer relationships and provide occasional information on specialized topics, services, or offers. 

You may object to this data processing at any time by contacting us at: datenschutz@easybell.ch, with the subject line “Request to Stop Data Processing for Advertising Purposes.”

9.2.4 Provision of Contractual Services

We process personal data to the extent necessary to provide you with our contractual or pre-contractual services. The personal data processed includes, among other things, master data, contact information, contract details, and payment information.

When you place an order, we store your personal data (e.g., company name, first and last name, address, phone number, email address, and billing email address) in our ERP system. The ERP system is hosted in Germany.

Personal data that is absolutely necessary for delivery is shared with third-party service providers (e.g., shipping companies).

9.2.5 Data Processing in the Application Process

We collect and process applicants’ personal data for the purpose of handling the application process. 

If no employment contract is concluded, the application documents are automatically deleted six months after notification of the rejection decision.

We have linked social media profiles such as Facebook, LinkedIn, Xing, and YouTube on our website. You can recognize the plugins by the respective logos on our site. We do not collect any data when you click on these links.

We communicate with you via social media platforms. This is based on your and our legitimate interest in exchanging information with one another in this way.

Please be aware that the operator of the social media platform uses web tracking methods. This web tracking, over which we have no control, may occur regardless of whether you are logged in or registered with the social media platform.

For more detailed information on data processing by the social media platform provider, please refer to the privacy policy of the respective provider. The company’s registered office is also the destination country for any data transfers.

Our website incorporates so-called widgets from review platforms to inform customers about other customers’ experiences with Easybell. A widget is a functional and content element integrated into our website that displays dynamic information. Although the corresponding content is displayed on our website, it is retrieved in real time from the review platform’s servers. This is the only way to ensure that the most up-to-date content—especially the current rating—is always displayed.

The Trustami Trust Seal is integrated into this website to display collected reviews and social media feedback. This serves to advance our legitimate interests in optimally marketing our offerings on our own website. When the Trustami Trust Seal is accessed, the web server automatically stores data (access data) in the form of a server log file, which includes the name of the accessed webpage, the file, the date and time of the request, your IP address in truncated form, the amount of data transferred, confirmation of a successful request, the browser type, the user’s operating system, the referrer URL (the previously visited page), and the requesting provider. This access data is not analyzed and is automatically overwritten no later than seven days after the end of your visit to the site. The Trustami Trust Seal and the services advertised through it are provided by Trustami GmbH, Schröderstrasse 5, 10115 Berlin.

We participate in the review process offered by Trustpilot A/S, Pilestræde 58, 5, 1112 Copenhagen, Denmark.

Trustpilot offers users the opportunity to review our services. Users who have used our services may be asked to consent to receiving a review request. If consent has been given (e.g., by clicking a checkbox or a link), users will receive a review request with a link to a Trustpilot review page.

To ensure that reviews can only be submitted by users who have actually used our services, we provide Trustpilot with the necessary data about the user and the service used. This includes, in particular, the user’s name, email address, and a reference number.

This data is used exclusively to verify the authenticity of the review and to contact the user.

Data processing as part of the review process is based on the consent of the data subject.

To submit a review, you must create a user account with Trustpilot. In this case, Trustpilot’s Terms of Service and Privacy Policy also apply.

To ensure the neutrality and objectivity of the reviews, we have no direct influence over the content of the reviews and cannot modify or delete them ourselves. Any requests regarding this matter must be directed to Trustpilot.

Integration of the Trustpilot Widget
We may integrate a Trustpilot widget on our website. When a corresponding page is accessed, a data connection to Trustpilot’s servers is established. In doing so, Trustpilot receives certain technical access data—in particular, the IP address—which is necessary to deliver the widget’s content.

In addition, Trustpilot receives the information that a user has visited our website. This information may be stored in cookies and used by Trustpilot to identify which online services participating in the Trustpilot review process have been visited by a user. The information may be associated with a user profile and used for analysis, advertising, or market research purposes.

The processing of personal data in connection with the integration of the Trustpilot widget is based on our legitimate interest in informing our users about the quality of our services.

To continuously improve our services and products, we occasionally conduct customer satisfaction surveys. For this purpose, we use the SurveyMonkey survey tool provided by Momentive Europe UC, 2 Shelbourne Buildings, Shelbourne Road, Ballsbridge, Dublin 4, Ireland.

The processing of personal data in connection with the conduct of surveys is based on our legitimate interest in obtaining feedback on the quality of our services and optimizing them.

To the extent that the use of cookies or similar technologies in connection with the integration of surveys requires consent, processing is based on the consent of the data subject.

The surveys are integrated using so-called inline frames (iFrames), through which external content from SurveyMonkey is embedded directly into our website. When a user visits a webpage containing such a survey, the user’s browser establishes a direct connection to Momentive’s servers. The content of the iFrame is transmitted directly from Momentive to the user’s browser and integrated into our website.

In doing so, Momentive may process, in particular, technical access data—such as the IP address—as well as cookies stored on the user’s device. We have no influence over the type or scope of the data collected by Momentive.

We treat your personal data as confidential and will only disclose it if you have consented to such disclosure, if we are legally obligated or authorized to do so, or if it is necessary to enforce our rights.
In addition, we may share your personal data with third parties to the extent that this is necessary or appropriate in connection with your use of the website or for the provision of any services you have requested (including outside the website).

In doing so, we naturally comply with the legal requirements governing the disclosure of personal data to third parties. If we use data processors to provide our services, we take appropriate legal precautions, such as a data processing agreement, as well as corresponding technical and organizational measures to ensure the protection of your personal data in accordance with the relevant legal provisions.

If the level of data protection in a country where personal data is processed does not comply with applicable data protection regulations, we ensure through contractual arrangements that the protection of your personal data is equivalent at all times to that in Switzerland or the EU/EEA, for example, by incorporating the EU Standard Contractual Clauses.

We process and store your personal data only for the period necessary to fulfill the purpose of storage or to the extent required by the laws or regulations to which we are subject. If the purpose of storage no longer applies or a mandatory retention period expires, your data will be routinely blocked or deleted in accordance with legal requirements.

We implement technical and organizational security measures (e.g., encryption of data in transit (TLS) and at rest, role-based access control, optional two-factor authentication, regular backups, and audit logging) to protect your personal data against tampering, loss, destruction, or unauthorized access, and to ensure the protection of your rights and compliance with applicable data protection regulations.

The measures taken are intended to guarantee the confidentiality and integrity of your personal data and to ensure the long-term availability and resilience of our systems and services when processing your personal data. They are also intended to ensure the rapid restoration of the availability of your personal data and your access to it in the event of a physical or technical incident.

Our data processing and security measures are continuously improved in line with technological developments.

We also take our own internal data protection very seriously. Our employees and the service providers we engage are bound by confidentiality obligations and are required to comply with data protection regulations. Furthermore, they are granted access to personal data only to the extent necessary.

To keep pace with technological developments, we use artificial intelligence (AI): This is used exclusively for optimization and innovation purposes, primarily to further develop our products. We do not use any personal data in this process. The use of AI serves a purely supportive purpose. We regularly train our employees in the use of AI.

You also have the right to request the correction of any inaccurate personal data and, if necessary, the completion of any incomplete personal data in our systems.

You may request that the processing of your personal data be restricted via datenschutz@easybell.ch.

If the processing of your personal data has been restricted, such data—apart from its storage—may be processed only with your consent or for the purpose of asserting, exercise, or defense of legal claims, or to protect the rights of another natural or legal person, or for reasons of a substantial public interest.

You have the right to request that your personal data be deleted by contacting datenschutz@easybell.ch, for example, if the data is no longer needed for the purposes for which it was collected. However, if we are required to retain your personal data due to statutory or contractual retention obligations, we can only restrict or block your personal data to the extent necessary in such cases.

You have the right to receive your personal data in a structured, commonly used, and machine-readable format.

You have the option to object to the collection and storage of data as described in the Privacy Policy. You may also revoke the consent you have given us for the collection and use of your data at any time, effective for the future, without providing a reason, by contacting us at datenschutz@easybell.ch.

Complaints in Switzerland may be submitted at any time to the Swiss Federal Data Protection and Information Commissioner (EDÖB):
